Establishment, Nature And Status Of The Scheme

The fund was established under a trust deed dated 1 September 2000 (Principal Deed) as a defined contribution plan to provide retirement benefits for the staff of Telkom Kenya Limited and its subsidiaries under the rules of the fund. The fund is an exempt approved fund under the Income Tax Act and is registered with the Retirement Benefits Authority.

On 30 November 2007, the fund’s founder, Telkom Kenya Limited, gave the fund notice of its intention to discontinue payment of contributions to the fund in accordance with the Principal Deed, upon which date the members of the fund would cease to accrue any further pensions or other benefits under the fund in respect of their service with the founder. On 20 December 2007, the founder and trustees amended the Principal Deed and existing rules of the fund and adopted an amended deed with effect from 1 December 2007 (the Deed of Amendment).

All contributing members were invited to take up membership of and transfer their accrued benefits to Zamara Fanaka Retirement Fund, a registered umbrella retirement benefits scheme in which the founder resolved to participate in with effect from 1 December 2007.
